Welcome to Luxury Fitness Personal Training LLC. These Terms and Conditions (“Terms”) govern your use of our services, website, mobile application, and any associated content (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.
1. Service Areas
Luxury Fitness offers premium concierge wellness services in select areas of Florida and North Carolina, including:

Florida: Wellington, West Palm Beach, Palm Beach, Palm Beach Gardens, Boca Raton, Delray Beach, Pompano Beach, Deerfield Beach, and surrounding areas.

North Carolina: Charlotte and surrounding areas.
We may expand or modify service areas without notice. Availability is subject to local contractor coverage.
2. Services Provided
Luxury Fitness provides the following concierge wellness services:

In-home and on-site personal training

Virtual nutrition coaching via a licensed registered dietitian

In-home massage therapy
All services are provided by independent contractors under the direction of Luxury Fitness Personal Training LLC.
3. Client Responsibilities

Clients must provide a safe and clean environment for in-home services.

Clients must disclose any health concerns, limitations, or injuries prior to beginning services.
-
Clients must have an active internet connection for virtual sessions.
-
Clients agree to download and use the Luxury Fitness mobile application for scheduling, communication, and tracking.
4. Session Packages and Payments
-
Monthly Plans: Includes personal training only, cancellable at any time.
-
12-Week Plans: Paid in full to receive bonus services (monthly in home massage sessions and monthly virtual nutrition coaching completely free).

Sessions must be scheduled through our app or with your assigned expert.

All services must be prepaid. No unpaid sessions will be conducted.
5. Cancellations and Rescheduling

Sessions canceled less than 4 hours in advance will be forfeited and not refunded or rescheduled.

Exceptions may be granted for emergencies at the sole discretion of Luxury Fitness Personal Training LLC

If a contractor cancels, a makeup session will be provided.
6. Program Structure and Session Expiration

Monthly Program: Clients have 30 days plus an additional 14-day grace period to use all sessions.
-
12-Week Program: Clients have 90 days plus an additional 30-day grace period to use all sessions.

This expiration policy ensures consistency and helps clients stay on track with their wellness goals. If the client needs more time, we will provide an additional 14-day grace period.

Six-Month Clients: All sales are final. No refunds for unused sessions unless Luxury Fitness terminates the agreement.

Any refund approved will be issued to the original payment method within 7-10 business days.
7. Refund Policy

Completed Sessions: No refunds

Unused Sessions: If the client terminates the agreement, the client will receive 50% refund on unused sessions. If the company terminates the agreement, the client will receive 100% refund of unused sessions.
8. Travel Policy

In-home sessions are intended for when the client is local. If traveling, virtual travel sessions are available for $50 each.

Travel session credits are not interchangeable with in-home sessions.
9. Health Disclaimer
Our trainers and registered dietitians provide general fitness and nutritional guidance. This is not medical advice. Always consult your physician before beginning any fitness or nutrition program.
10. Independent Contractors
All services are provided by licensed or certified independent contractors who operate under the standards set by Luxury Fitness Personal Training LLC. We perform background and credential checks to ensure safety and quality.
11. Intellectual Property
All content, including but not limited to training materials, images, videos, logos, and written content, are the property of Luxury Fitness and may not be copied, distributed, or used without written consent.
12. Limitation of Liability
Luxury Fitness is not liable for:

Injuries sustained during sessions due to client negligence or undisclosed conditions.

Damage to personal property during in-home sessions.

Service delays or disruptions due to technology failure or force majeure.
13. Termination
We reserve the right to terminate services at any time for violations of these Terms, including but not limited to harassment, unsafe environments, or failure to pay.
14. Privacy
All client data is stored securely and used solely for the delivery of services. We do not sell or share personal information with third parties without consent. Refer to our Privacy Policy for full details.
15. Modifications
Luxury Fitness Personal Training LLC reserves the right to modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida and the State of North Carolina, depending on the location in which services are rendered. Any disputes shall be resolved through binding arbitration in Palm Beach County, Florida, or Mecklenburg County, North Carolina, as applicable.
