These Terms & Conditions (“Agreement”) govern the provision of in-home massage therapy services by independent, licensed, and insured massage therapists contracted by Luxury Fitness Personal Training LLC (“Company”). By scheduling or receiving services, the client (“Client”) affirms their understanding of and agreement to the following terms:
Scope of Policy
The Company provides non-medical, in-home massage therapy services solely for therapeutic and wellness purposes. These services are delivered by independent contractors who are duly licensed and insured massage therapists. Massage therapy services provided under this Agreement are not intended to diagnose, treat, or replace medical care provided by a licensed physician or healthcare professional.
2. Client Health Disclosures
Prior to receiving services, the Client shall accurately and completely disclose all known medical conditions, injuries, allergies, and other relevant health information via the Company’s required intake form. The Company and its contractors shall not be held liable for any injury, adverse event, or consequence arising from undisclosed or inaccurate health information.
3. Appointment Scheduling and Therapist Availability
Sessions are scheduled by mutual agreement based on therapist availability. The Company reserves the right to assign alternate therapists, adjust appointment times, or reschedule services in the event of unforeseen circumstances or therapist unavailability.
4. Cancellation and Rescheduling Policy
The Client agrees to provide a minimum of 24 hours’ advance notice for any cancellation or rescheduling request. Failure to do so may result in the Client being charged a cancellation fee equivalent to the full service rate. No-shows will be considered a forfeited appointment, subject to full charge. Exceptions to this policy are granted solely at the discretion of the Company.
5. On-Site Environment Standards
The Client is responsible for ensuring that the in-home environment is safe, hygienic, and appropriate for professional massage therapy. Therapists reserve the right to refuse or terminate a session immediately if the environment poses safety concerns, lacks reasonable privacy, or if any inappropriate conduct occurs. In such cases, the Client may be charged the full session rate.
6. Professional Conduct
Massage therapy services provided under this Agreement are strictly professional and therapeutic in nature. Any inappropriate behavior, remarks, or conduct exhibited by the Client will result in immediate termination of the session and may result in permanent removal from the Company’s service program without refund.
7. Liability and Assumption of Risk
To the fullest extent permitted by law, the Client voluntarily assumes all risks associated with receiving massage therapy services. The Company and its independent contractors expressly disclaim any liability for personal injury, property damage, or any other loss arising from the services provided, except where such injury or loss is the direct result of gross negligence or intentional misconduct.
8. Fees, Payments, and Refunds
Session fees shall be paid in accordance with the Company’s prevailing rates and payment policies. All fees are due in full prior to or at the time of service, unless expressly agreed otherwise in writing. Refunds are issued solely at the discretion of the Company.
9. Modifications to Terms
The Company reserves the right to amend, revise, or update these Terms & Conditions at any time. Continued use of services following any amendment constitutes acceptance of the revised terms. The most current version shall be made available to Clients upon request.
